1. Introduction
  1.1. These Terms and Conditions ("Agreement") govern the use of the Software as a Service (SAAS) property management platform ("Platform") provided by Propmgt.io by Wackywow.com LLC ("Provider") to the users ("User" or "You"). By accessing or using the Platform, you agree to be bound by this Agreement.
2. Services
  2.1. The Platform provides property management features and functionalities, including but not limited to tenant management, rent collection, property maintenance tracking, communication tools, and reporting.
3. User Accounts
  3.1. In order to use the Platform, Users may need to create an account. Users are responsible for maintaining the confidentiality of their account credentials and are liable for any activities that occur under their account.
4. Subscription and Fees
  4.1. The use of the Platform requires a subscription. The details of the available subscription plans, including features, pricing, and payment terms, will be provided by the Provider separately or on the Platform's website.
5. Data Ownership and Usage
  5.1. Users retain ownership of all data they input into the Platform. By using the Platform, Users grant the Provider a limited license to use, store, and process their data to provide the services.
6. Data Protection and Privacy
  6.1. The Provider will handle User data in accordance with its Privacy Policy, which can be found on the Platform's website or provided separately. The Provider will take reasonable measures to protect User data, but cannot guarantee absolute security.
7. Intellectual Property
  7.1. The Platform and all associated intellectual property rights belong to the Provider. Users are granted a limited, non-exclusive, non-transferable license to use the Platform for the duration of their subscription.
8. Limitation of Liability
  8.1. The Provider will not be liable for any damages or losses arising from the use of the Platform, including but not limited to loss of data, interruption of services, or any indirect, incidental, or consequential damages.
9. Termination
  9.1. Either party may terminate this Agreement with prior notice. Upon termination, User access to the Platform will be revoked, and Users may be required to delete any copies of the Platform in their possession.
10. Modifications to the Agreement
  10.1. The Provider reserves the right to modify this Agreement at any time. Changes will be effective upon posting the updated terms on the Platform or providing notice to Users. It is the User's responsibility to review the terms periodically.
11. Governing Law and Jurisdiction
  11.1. This Agreement shall be governed by and construed in accordance with the laws of USA. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of USA.
